VIDOL Ensures Protection of Employee Rights Following Kmart West Closure Announcement

USVI– Commissioner Gary Molloy informs the public that the Virgin Islands Department of Labor (VIDOL) has received notice from Transform KM LLC (Kmart or Company), locally known as Kmart West, indicating a closure that could affect approximately 75 individuals. In response, the Department of Labor has launched an investigation to ensure that the rights of all affected employees are fully protected.

VIDOL is committed to upholding the rights and well-being of workers across the Virgin Islands. Upon receiving the notice, immediate action was taken to initiate an investigation into the closure and to assess the potential impact on the affected employees. Commissioner Molloy stated, “We are deeply concerned about the potential impact of the Kmart West closure on the affected individuals and their families. Our priority is to ensure their rights are upheld and they receive the support they need during this challenging time.”

VIDOL’s investigation will ensure that all members’ rights under the labor laws and regulations, including the Virgin Islands Plant Closing Act, Title 24 Sections 471-478, and the Worker Adjustment and Training Notification Act (WARN) of 1988, are properly observed. All affected employees are encouraged to familiarize themselves with their rights and contact the Department of Labor for guidance and support throughout the process. VIDOL stands ready to provide assistance, answer questions, and address concerns related to the closure and protections guaranteed by law.

VIDOL is dedicated to promoting a fair and safe workplace for employees through rigorous enforcement of labor laws, comprehensive investigations, and proactive initiatives while providing crucial support and resources to workers impacted by closures. With a commitment to upholding employee rights, the Department ensures that affected individuals receive the necessary assistance during their transition to new employment opportunities.
